Terms of Service for Mobile App

1. Introduction

Welcome to Appo ("we," "our," or "us"). These Terms of Service govern your use of our mobile application and services. By accessing or using our app, you agree to comply with and be bound by these terms. If you do not agree to these terms, please do not use our app.

2. Use of the App

You must be at least 16 years old to use the app. You are responsible for ensuring that your use of the app complies with all applicable laws and regulations. You may not use the app to engage in unlawful, abusive, or harmful activities, nor may you share your license or access credentials with others. You may not modify, distribute, copy, reverse engineer, or decompile the app.

3. Intellectual Property

The app and all intellectual property rights, including software, logos, and trademarks, are owned by Appo. Your use of the app does not grant you ownership rights to any aspect of the app or its content.

4. In-App Purchases and Subscriptions

All in-app purchases and subscriptions are processed through Apple's App Store. You agree to pay all fees associated with your purchases.

For subscriptions, the price you agree to at the time of purchase will remain in effect for the duration of your subscription. We may introduce new subscription tiers or options at different price points, but these changes will not affect the price of your existing subscription.

5. Refunds

We do not handle refunds directly for purchases made through Apple's App Store. Refunds and other transaction-related issues are subject to Apple's refund policies and must be handled according to their procedures.

To request a refund for an in-app purchase or subscription, you must contact Apple's App Store customer support. Their refund policies and timelines will apply, and any decisions regarding refunds will be made at their discretion.

Refund eligibility is determined by the App Store's policy. Refunds may be available for purchases made in error, technical issues, or other circumstances deemed valid by the App Store.

6. User-Generated Content

You are responsible for all content you create or transmit through the app, including events, client information, and SMS messages. You must not create or transmit content that is illegal, offensive, or otherwise violates these terms and Notifications Restrictions. We reserve the right to remove or restrict access to any content that violates our policies.

7. User Responsibilities for Client Data

If you choose to store personal information of your clients or other individuals ("Client Data") in our app, you are responsible for obtaining all necessary consents and informing these individuals about data storage in Appo. You must comply with all applicable data protection and privacy laws and implement appropriate measures to protect this data. Appo acts as a data processor for Client Data, and we will only process this data as necessary to provide our services. Our handling of Client Data is subject to our Privacy Policy, which you should review to ensure your use of Client Data aligns with it. By using our app to store Client Data, you agree to indemnify Appo against any claims arising from your storage and use of such data.

8. Online Booking Feature and Restricted Content

The app provides an optional online booking feature, which allows you to share your availability, services, and other relevant information through a personal booking link. By enabling this feature, you agree that the information shared through the link, including your name, phone number, chosen address, selected services, and available time slots, is accurate and lawful. You retain full control over enabling or disabling this feature and are responsible for ensuring the information you share complies with these Terms of Service.

You are strictly prohibited from using the online booking feature or any other functionality of the app to create, share, or promote the following types of content:

  • Illegal products or services, including but not limited to controlled substances, drugs, weapons, and counterfeit items.
  • Sexually explicit, obscene, or pornographic content, including solicitation of prostitution or other sexual services.
  • Content that incites violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected status.
  • Fraudulent schemes, phishing attempts, or deceptive practices designed to mislead users.
  • Copyright-infringing materials, including unauthorized use of trademarks, logos, or other intellectual property.
  • Malicious software, viruses, or other content designed to harm or exploit users or their devices.
  • Harassment, defamation, or any content that infringes on the privacy or rights of others.
  • Any other content that violates applicable local, national, or international laws or regulations.

We reserve the right to review, remove, or restrict access to any content that violates these terms, at our sole discretion. Repeated violations may result in suspension or termination of your account and access to the app.

By using the online booking feature, you acknowledge that you are responsible for ensuring that your use of the app and the content you share comply with all applicable laws and these Terms of Service. Appo disclaims any liability for the content shared through your personal booking link.

9. Account Responsibilities

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately if you suspect any unauthorized access or use of your account.

10. Data Privacy and Security

Your use of the app is subject to our Privacy Policy, which outlines how we collect, store, and handle your personal information. By using the app, you agree to our handling of your data in accordance with the Privacy Policy.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service. Upon termination, you will no longer have access to the app, and any associated data will be deleted.

12. Limitation of Liability

To the fullest extent permitted by law, Appo is not liable for any direct, indirect, incidental, or consequential damages resulting from your use or inability to use the app. The app is provided "as is" without warranties of any kind, either express or implied.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the United States, Canada, and the European Union, depending on the region where you reside. For users in California, the applicable law is the California Consumer Privacy Act (CCPA). For Canadian users, the applicable law is the Personal Information Protection and Electronic Documents Act (PIPEDA). For European Union users, the applicable law is the General Data Protection Regulation (GDPR).

14. Export Control

You agree to comply with all applicable export control laws when using the app. You may not use or otherwise export or re-export the app except as authorized by United States law and the laws of the jurisdiction in which the app was obtained.

15. Force Majeure

Neither party shall be liable for any failure or delay in performance under these Terms (other than for delay in the payment of money due and payable hereunder) for causes beyond that party's reasonable control and occurring without that party's fault or negligence.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

17. Assignment

You may not assign, sublicense, or otherwise transfer any of your rights under these Terms without our prior written consent.

18. Changes to the Terms

We may update our Terms from time to time. Any changes will be posted on this page, and your continued use of the app after such changes means you accept the updated terms.

19. Entire Agreement

These Terms constitute the entire agreement between you and Appo with respect to the app, superseding any prior agreements between you and Appo.
